Reservations for short-term holiday accommodation are accepted by Flutes Holiday Homes 23 807 746 195 (“the Booking Agent”) as agent for the Owner of the Property and to which bookings the following terms and conditions apply:

Rental Contract

The rental contact is between the Guest and the Owner of the Property for which the accommodation booking is made and is subject to the terms and conditions herein. The contract for accommodation shall not be effective until the Booking Agent sends the Guest written confirmation of the booking. Payment of the Deposit constitutes acceptance of these Terms and Conditions. The Guest acknowledges that the Booking Agent acts as a booking agent for the Owner only and not as a principal.

Check-in/out

Check-in time is not before 3pm on the arrival date and check out time is not later than 10am on departure date.

Late departure is subject to prior arrangement and availability and extra charges may apply.

Check-in/check-out and key collection/return procedure will be emailed 30 days prior to the commencement of the stay if all monies owing have been paid unless special arrangements have been made prior to arrival.

Linens, Towels & Cleaning

We supply linen, pillows, blankets, bathroom towels and kitchen towels. Beach towels are not included. It is requested that the house, including the BBQ, is left in a clean and tidy condition with waste removed and dishes cleaned and packed away. Please ensure cooktop, oven, microwave oven and fridge/freezer are wiped clean. The price does include a basic holiday clean, however the guest will be liable for the cost of excess cleaning which will be deducted from your bond provided at a rate of $55 per hour. Mid stay cleaning is not included with any booking. Should like this added to your booking please arrange 14 days prior to your stay. The clean will be carried out once the property has been vacated.

WiFi

Wifi is provided to some properties (please check individual property description) When provided, please note being rural properties, we are only able to supply you with satellite internet and as such the downloads are very limited. Please avoid streaming and downloading large files as the data will be consumed quickly.

Pets

Pets are not allowed. Forfeiture of the full Security Bond for pets brought to a property without prior permission.

Noise & Neighbours

We want you to enjoy your stay but please be aware of the impact of your noise on others and keeping our neighbours happy is of high importance. Noise and music should not impact any other property and noise levels are to be respectful at all times. There is to be no outdoor music or outdoor entertaining after 10pm. Noise complaints will result in bond deductions and possible eviction.

Guest’s Obligations in Respect of the Property

The Guest shall be responsible for the Property during the Guest’s stay. The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property including all utensils, fixtures, fittings and equipment on, in or about the Property in a clean and tidy condition. The Guest shall be liable for any extra cleaning, breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest’s occupation of the Property and all costs for extra cleaning, repair and replacement thereof shall be payable to the Booking agent or the Owner from the Guest Security Bond. Any such costs over and above the amount taken as a Guest Bond may be sought by the Owner through the Local Court. Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the Booking Agent or Owner as soon as practicable after the damage occurring thereto.

Problems or complaints

You will be enjoying wonderful privacy and seclusion at this accommodation, but please note that occasionally as with any rural property there might be some interruptions to the water and electrical supply. We always do our best to reinstate immediately once notified.

In the case of any problem or complaint, you must inform Booking Agent at the earliest opportunity there is chance to rectify the situation as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours.

Any complaint, which cannot be resolved locally, must be notified in writing to Booking Agent prior to departure from the Property.

Failure to follow this procedure this may hinder the ability of Booking Agent to rectify the problem or complaint and reduce or extinguish any claim you may have.

We recommend all guests purchase travel insurance since Booking Agent are not responsible for any injuries, illness or accidents that may occur whilst staying at our property.

Indemnity

The Owner and Booking Agent of the property do not condone unsafe, unruly, irresponsible or illegal conduct/behaviour on the premises during your stay. The Owner and Agent accept no responsibility for any actions, incidents, loss, damage or injury sustained during your stay at the premises. The Guest accepts and agrees that a condition of the stay and use of facilities at the property is that all guests indemnify and agree to keep indemnified the Owner and Agent against all liability whatsoever and howsoever arising including but not limited to any actions, incidents, loss or injury sustained during their stay at the property.

The tenant indemnifies the agent against any liability which may result through injury or loss being personal or proprietary suffered by any person where any injury, damage or loss has been contributed to or caused by any act or occasion of the tenant or his agent. The agent reserves the right to be sole arbitrators in the event of a dispute.

Guest’s Property

All personal belongings, baggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and neither the Booking Agent nor the Owner accepts any responsibility for any loss or damage thereto. All personal items left behind will be held for a period of 30 days. Please make arrangements for any items left behind to be picked up within the 30 days, otherwise they will be disposed of.

Guest Numbers & Functions

The Guest may only allow the Property to be occupied by the number of persons nominated in the Guest’s application and under no circumstances shall the number of people occupying the Property be greater than that appearing on the Guest’s application or the booking confirmation, whichever is the lesser. The Booking Agent and Owner reserve the right to refuse occupation of the Property to the Guest if the condition on the number of people intended to occupy the Property is not observed. Shire regulations allow holiday homes to be rented for accommodation purposes only and not as a function venue eg. for a wedding. Functions and gatherings are not permitted and, if evidenced, may be closed down immediately and result in the security bond forfeited in full.

Right to Refuse or Revoke Bookings

The Booking Agent and the Owner reserve the right to revoke or refuse to honour any property accommodation booking which may in the opinion of either party (and at their sole discretion) be unsuitable for the Property concerned.

Representations

The Guest acknowledges that the Booking Agent has used its best endeavours to describe the Property to the Guest within the limited extent of the communications between the Guest and the Booking Agent and the Booking Agent shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever.

Description of the Property

All information in respect of the Property contained in the Booking Agent’s website is believed to be correct at the time of the publication, however, all details are subject to change by the Booking Agent and/the Owner without notice. The Booking Agent will not accept any responsibility for any alterations to the Property or any part thereof beyond the Booking Agents control or any liability for any matter or occurrences beyond the Booking Agents reasonable control including damage caused by extreme weather conditions, breakdown of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.

Availability of Property

The short-term accommodation contract negotiated by the Booking Agent and made between the Guest and the Owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest. Should any events whatsoever arise beyond the reasonable control of the Booking Agent which render the Property uninhabitable (for example flood, fire, storm, tempest, etc) or the property becomes for sale or is sold by the Owner, then the Booking Agent may have to cancel the Guest’s booking for the Property. Should such circumstances arise then the Booking Agent will endeavour to relocate the Guest to a holiday home of a similar standard to the property in the same area. Where this is not possible, the Booking Agent will refund all monies paid by the Guest in respect of the Property. Upon refund of the monies paid, the guest shall have no further claims whatsoever against the Owner of the Property or the Booking Agent
